Yesterday I posted a question. I wanted to know if anyone knew a good upload site that I could post a "pirated" movie. The next day I noticed that my post was "Edited for Content." I never read your TOS, I did what everyone does an clicked agree. I didn't actually POST anything other than a question. My question to you is this. How can you say that pirated anything isn't allowed, yet you have a whole section on Homebrew games? Which in essence is pirated software. Sony doesn't want you to play homebrew games, and hackers are writing software to crack the PSP code. It seems to me you are being very hypocritical about what is acceptable and what isn't. I hope you can shed some light on this. Thanks. |

I read somewhere that homebrew is, technically, illegal. It is because when the game is first created, it is licensed to the company for a certain time period after which it is public. Gaming hasen't been around for very long, so this little 'grace period' has ended yet, making it illegal.

You know... the rules are the rules so that is good enough..
It is good that you question them.. but bad that you didn't read them first. I am sure not all homebrew applications are illegal... I am also sure that the use of , now out of copyright, roms is also not illegal... at the very most a grey area.... But the blatant act of pirating games and films is illegal and as such not permitted on this site. These are the rules... you don't have to like them or agree with them just abide by them if you want to stay on this site... and to that end you are more than welcome even if your activities on the site do not reflect your active interest in pirate this and that off site. A bit of a silly comparison, hosting a bootleg (be it a TS or a CAM) versus talented developers who actually create software.
I don't know how much you know about the MPAA's anti-piracy tactics, but do you realize that being caught with a single illegal copy of a movie is generally a $250,000 fine and additional items are $25,000 each? Now more than ever they're cracking down on people downloading/distributing such files as movies that say, just came out in theaters...sound familiar? Homebrew does not = games (illegal or otherwise). Perhaps you're thinking about emulators (which are created by developers) and the ROMs they use. The emulators themselves are homebrew software; ROMs are universal and can be used across a wide variety of platforms, not just the PSP. Sure, many of them are illegal to download in theory; some say "well I own the game, etc" but that really doesn't hold any water in the grand scheme of all things legal. That being said, there are still games that are licensed for public distribution (Duke Nukem 3D PSP port comes to mind), so no they're not illegal. I think you need to get a better understanding of what "homebrew" is; its not another word for illegal games, it generally refers to a variety of software that can be used on your PSP in completely legal ways and to do a variety of other things.

I don't know if cracking the PSP code is illegal. Homebrew applications certainly aren't illegal. The ROM's that run on these homebrew emulators are illegal unless the user owns a licensed copy. The ROM's in general are that old decent programmers could replicate the game with infringing copyright.

Yes, I meant $250,000.00 for the first infraction and $25,000.00 for additional items. :shock:
